Terms and Conditions

1. Agreement to Terms
These Terms and Conditions ("Terms") govern access to and use of Poolbench (the "Service"), operated by Poolbench ("we," "us," "our"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you are agreeing on behalf of a pool-service company or other organization ("Company"), you represent that you have authority to bind that Company, and "you" refers to both you and the Company.
If you do not agree to these Terms, do not use the Service.
2. The Service
Poolbench is a business-management tool for pool-service companies. It lets a Company's staff record water-test readings during service visits, generates water-health scores and chemical-dosing recommendations, schedules visits, and shares read-only reports and pool status pages with the Company's own customers ("Homeowners").
Poolbench also offers native mobile apps (Android and iOS) that load the hosted Service inside a wrapper app. These Terms apply equally to use of the Service through the website and through the mobile apps. Where the app is distributed through the Apple App Store or Google Play, the applicable store's usage terms also apply, and in the event of a conflict between those terms and ours regarding the license grant, the stricter terms control.
3. Accounts and Roles
You must provide accurate registration information and keep your credentials confidential. You are responsible for all activity under your account.
Accounts within a Company are assigned one of the following roles, which determine what the account can access:
- Owner — manages the Company's team, billing/subscription, integrations, and API keys, in addition to field functions.
- Tech — performs and records service visits; scoped to the work assigned to them.
- Super Admin — a Poolbench platform-operator role with cross-tenant access for support and administration; not assignable to Company customers.
We are not responsible for losses caused by a Company's own management of its users' roles and permissions.
4. Subscriptions, Trials, and Billing
Plans. The Service is offered on a per-Company (not per-seat) subscription, currently in three tiers — Starter, Basic, and Pro — differing in the number of pools and techs supported, the level of water-health scoring, and access to features such as service reports, QR codes, scheduling, custom branding, priority support, CSV import, and API access. Current plan details and pricing are shown in-app and may change from time to time; we will provide notice of material pricing changes before they take effect on your next billing cycle.
Free trial. New Companies receive a 30-day trial with full feature access regardless of the plan ultimately selected. We will send a reminder before your trial ends and a notice when it expires. If no paid plan is active when the trial ends, the Company's plan status becomes expired and premium features are no longer accessible until a plan is purchased; your data is not deleted solely because a trial has expired.
Payment. Subscriptions are billed through Stripe or PayPal, at your election. A Company may have only one active payment provider at a time; switching providers cancels the prior subscription with that provider. By subscribing, you authorize recurring charges to your chosen payment method until you cancel or downgrade.
Upgrades and downgrades. Upgrades take effect immediately and are billed on a prorated basis. Downgrades take effect at the end of the current billing period; feature access changes accordingly at that time, including for API access, which is checked live on every request rather than cached.
Cancellation and refunds. You may cancel your subscription at any time from account settings; cancellation stops future billing but does not entitle you to a refund for the current billing period except where required by law.
5. Acceptable Use
You agree not to:
- Use the Service to store or transmit unlawful, infringing, or harmful content;
- Attempt to access another Company's data, or circumvent the tenant isolation that separates Companies' data from one another;
- Exceed, circumvent, or abuse API rate limits (currently 60 requests per minute per API key) or otherwise interfere with the Service's normal operation;
- Reverse-engineer, resell, or use the Service to build a competing product;
- Use the Service to collect or transmit Homeowners' personal data for any purpose other than providing pool-service business services to that Homeowner.
We may suspend or restrict access for use that violates these Terms, poses a security risk, or as required by law.
6. Your Content and Data
What you submit. The Service allows you to enter and store pool and service information, including pool notes, service-visit notes, water-chemistry readings, Homeowner contact details, uploaded images (pool photos, company logos), and feedback you submit to us (bug reports, feature requests, and similar communications).
Ownership. As between you and us, you retain ownership of the data you submit ("Customer Data"). You grant us a license to host, process, and display Customer Data solely to provide and improve the Service.
Company as data controller. Poolbench is a business tool used by pool-service Companies to manage their own customers. As between a Company and its Homeowners, the Company — not Poolbench — is responsible for the accuracy of, and has the relevant legal relationship governing, the Homeowner data it enters into the Service (e.g., name, address, phone, email). Poolbench acts as a processor/service provider with respect to that data. Each Company is responsible for having a lawful basis to collect and enter its Homeowners' information into the Service and for its own relationship with those Homeowners.
Public links. Certain pages (pool status pages and service reports) are accessible via unauthenticated links so a Company can share them with its Homeowners. You are responsible for controlling distribution of these links, since anyone with the link can view the associated content.
Feedback. Feedback you submit to us may be used by us without obligation to compensate you, though we will not publicly attribute it to you without permission.
7. API Access
Companies on plans that include API access may generate API keys (Owner role only) to access a read-only REST API. API keys are your responsibility to keep secret; a key's secret is shown only once at creation. We may revoke keys or throttle requests that violate rate limits or these Terms. API access is re-verified on every request against your Company's active status and plan entitlement and may stop working immediately upon a downgrade, suspension, or non-payment.
8. Push Notifications
If you use the mobile apps, you may receive push notifications (e.g., visit-assignment alerts) via Apple Push Notification service or Firebase Cloud Messaging. You can disable these at the device level at any time; disabling them does not affect in-app notifications while the app is open.
9. Intellectual Property
The Service, including its software, design, and Poolbench branding, is owned by us or our licensors and is protected by intellectual property laws. Except for the limited rights expressly granted to use the Service, no other rights are granted to you.
10. Suspension and Termination
By you. You may delete your individual user account at any time from account settings; this removes your personal account but does not delete the Company's account or other users' data. An Owner may request closure of the entire Company account.
By us. We may suspend or deactivate a Company's account for non-payment, violation of these Terms, suspected fraud or security risk, or as required by law. A Super Admin may deactivate or permanently delete a Company account; deletion of a Company account is irreversible and removes that Company's users, pools, visits, invoices, API keys, and related records.
Effect of termination. Provisions of these Terms that by their nature should survive termination (including Sections 6, 9, 11, 12, and 13) will survive.
11. Disclaimers
The Service, including any water-health scores or chemical-dosing recommendations it generates, is provided as a business-management and decision-support tool. It does not replace the professional judgment of a certified pool technician, and we do not guarantee that recommendations are error-free or suitable for every pool. The Service is provided "as is" and "as available" without warranties of any kind, express or implied, to the maximum extent permitted by law.
12. Limitation of Liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the 12 months preceding the claim.
13. Indemnification
You agree to indemnify and hold us harmless from claims arising out of your misuse of the Service, your Customer Data, or your violation of these Terms or applicable law, including claims brought by your Homeowners regarding their personal data.
14. Governing Law
These Terms are governed by the laws of [governing jurisdiction — to confirm], without regard to conflict-of-laws principles. Nothing here limits statutory rights that cannot be waived under applicable law, including data-subject rights for users in the EU/EEA and UK.
15. Changes to These Terms
We may update these Terms from time to time. We will update the effective date above when we do, and for material changes we will provide reasonable notice (e.g., in-app notice or email) before they take effect.
